1. Agreement to Terms and Platform Scope
Welcome to BuildingOpts ("we", "our", "us", or the "Platform"). By accessing, browsing, purchasing, or downloading architectural assets, Building Information Modeling (BIM) files, or Computer-Aided Design (CAD) packages from BuildingOpts, you ("Client", "Licensee", or "User") agree to be legally bound by these Terms of Service and CAD Licensing Policy.
If you are accepting these terms on behalf of an architectural firm, engineering practice, developer, or corporate entity, you represent and warrant that you possess full legal authority to bind such organization to these provisions.
2. Digital CAD & BIM Deliverables and Usage Rights
Upon verified checkout and payment receipt, BuildingOpts grants you a non-exclusive, non-transferable license to access and use the coordinated digital files, including Autodesk Revit .RVT, AutoCAD .DWG, and universal .PDF packages, subject to the applicable terms of use and intellectual property protections set out in this policy.
- Authorized Use: Purchased files may be used as a reference or adapted for architectural planning, design development, visualization, and other lawful purposes consistent with the rights granted under this policy.
- File Ownership: Purchasing a model grants you the applicable usage rights but does not transfer copyright ownership or other intellectual property rights in the original model and its contents.
- Prohibited Redistribution: You may not resell, sublicense, rent, redistribute, publish, or make the original digital files publicly available as standalone assets without prior written authorization from BuildingOpts.
3. The "No Fragmented Upsells" Guarantee
BuildingOpts operates on complete delivery transparency. When you purchase a building model, you receive the full unified production asset bundle (3D BIM Model, 2D Working CAD Plans, Dimensioned Elevations, Sections, Schedules, and Universal Print-Ready PDFs) in a single integrated download archive. We do not withhold essential drawing sheets or levy unexpected tiered fees for standard CAD/BIM formats.
4. Engineering Verification and Local Statutory Approvals
Because soil bearing capacities, seismic factors, rainfall gradients, wind loads, municipal setback rules, and statutory building codes vary significantly across states, jurisdictions, and countries, you must retain locally registered professionals:
- A certified Structural Engineer to verify foundation depths, rebar schedules, and structural framing for your specific plot topography and geotechnical report.
- A certified Mechanical & Electrical (M&E) Engineer for localized services distribution.
- Local registered architects or statutory planning agents to submit documentation to the relevant town planning authorities for physical building permits and construction approvals.
5. Pricing, Currencies, and Payment Processing
Model prices are clearly published in Nigerian Naira (₦ NGN) for domestic checkout and United States Dollars ($ USD) for international patrons. Exchange rates and secondary conversions are configured transparently at the time of transaction.
Payments are processed securely via authorized Tier-1 payment infrastructure including Paystack, Flutterwave, Monnify, and verified direct studio bank transfers. BuildingOpts does not store or process raw credit/debit card numbers on its servers.
6. Instant Digital Delivery and Lifetime Client Library
Upon successful transaction validation, your unique cryptographic download token is generated. You receive instant digital access to download your full ZIP archive.
Furthermore, registered account holders maintain lifetime access to re-download their purchased packages directly within their authenticated Client Library (account.php) at any time.
7. Refund Policy & File Integrity Guarantee
Due to the irreversible digital nature of computer-aided architectural deliverables (RVT, DWG, and PDF assets), purchases are non-refundable once the digital archive has been downloaded or the secure download token has been accessed.
However, under our 100% File Integrity Guarantee, if any delivered archive is corrupt, incomplete, or damaged, our technical support desk will promptly re-issue, verify, and deliver valid uncorrupted files within twenty-four (24) hours of notification.
8. Custom Design Studio Engagements
For bespoke commissions initiated through our Custom Studio (custom-design.php), design briefs, milestone deliverables, iterative revisions, and site-specific adaptations are governed by an individualized Architectural Services Agreement executed prior to commencement of design production.
9. Intellectual Property and Copyright Ownership
All architectural configurations, Models, Floor plans, space programs, and artistic designs displayed on BuildingOpts are the proprietary intellectual property of BuildingOpts Architectural Studio and protected under international copyright treaties and domestic intellectual property statutes. Unauthorized reproduction or commercial plagiarism is strictly actionable at law.
10. Limitation of Liability and Governing Law
In no event shall BuildingOpts, its directors, architectural associates, or technical partners be held liable for indirect, incidental, consequential, or punitive damages arising from site construction errors, unauthorized plan modifications, contractor negligence, or statutory permit rejections.
These terms shall be governed by and construed in accordance with the substantive laws of the Federal Republic of Nigeria, without giving effect to conflict of laws principles.
